Park Rules


961.01   ALCOHOLIC BEVERAGES PROHIBITED.
   (a)   No person shall have in his possession or use any beer, liquor or wine, or other beverage having an alcoholic content, in or upon any property owned by the City for any purpose whatsoever or in or upon any property which the City has leased, rented or licensed, and which is under the control and supervision of the City or its officers or employees, except as otherwise provided in this section.
   (b)   The Administration is authorized to approve the possession, sale, service, and on-site consumption of alcoholic beverages at facilities owned or leased by the City, for public or private events, limited to designated areas and at restricted times, and subject to compliance with regulations and permit requirements of the Division of Liquor Control. Any vendor participating in the service of alcoholic beverages on City grounds must do so in compliance with R.C. Chapters 4301 and 4303 or as the holder of a permit issued by the Division of Liquor Control and in force at the time of service. The alcoholic beverages shall be served for consumption on the immediate premises only.

961.02   ANIMALS AND EXPLOSIVES PROHIBITED.
   No person shall bring or have in his possession any horses, unleashed animals, fireworks or other explosives in or on any property owned by the Municipality for any purpose whatsoever and in or on any property which the Municipality has leased, rented or licensed and which is under the control and supervision of this Municipality or its officers or employees.

961.03   LITTERING PROHIBITED.
   No person shall litter the grounds of any property owned by the Municipality for any purpose whatsoever or any property which the Municipality has leased, rented or licensed and which is under the control and supervision of the Municipality or its officers or employees with trash, rubbish, refuse or garbage of any kind. Every person shall dispose of such trash, rubbish, refuse or garbage by placing it in containers provided for such purpose.

961.04   VANDALISM PROHIBITED.
   No person shall commit any act of vandalism in or on any property owned by the Municipality for any purpose whatsoever and in or on any property which the Municipality has leased, rented or licensed and which is under the supervision of the Municipality or its officers or employees.

961.05   CONTRACTS FOR CONCESSIONS.
   Concession privileges, not constituting leases of real estate or any interest in real estate, at public parks and grounds of the City, shall be granted by written contract entered into on behalf of the City by the Director of Public Service. Such contracts shall be awarded by Council to the highest and best bidder after advertisement by the Director for bids at least once, in a newspaper of general circulation in the City. Such bids shall be based upon specifications and plans where necessary, prepared by the Director and on file in the office of the Director at the time of the first publication of notice and until the opening of bids. Bids shall be opened on the day specified in the advertisement for bids, which shall be at least seven days following the date of the first publication of such notice. Council may reject all bids.

961.06   USE OF MOTORCYCLES.
   No person shall use or operate any motorcycle, motorbike, motor scooter, mini-bike, mini-scooter, go-cart or similar vehicle propelled by an internal combustion engine in any park area or any area within the City devoted to or available for use for public recreation purposes.

961.07   PARK NAMES.
   (a)   Powers Road Park shall hereafter be known as Kurtz Park.
 
   (b)   Parma Heights Park shall hereafter be known as The Greenbrier Commons.
 
   (c)   The Nike Site shall hereafter be known as Nathan Hale Park.
 
   (d)   Stroud Park, located at Ackley Boulevard and Brookmere Drive, shall hereafter be known as and bear the name of Lexington Green.
 
   (e)   North Church Recreation Area, located at North Church and adjacent to Stroud Elementary School, shall hereafter be known as and bear the name of Stroud Park.
 
   (f)   Lexington Green shall hereafter be known as Radlick Park.

961.08   OPENING AND CLOSING HOURS.
   (a)   Except for unusual and unforeseen emergencies, parks shall be open to the public during designated hours.
 
   (b)   The opening and closing of each individual park shall be posted therein for public information.
 
   (c)   Nathan Hale Park, Lexington Green, Stroud Park and the Reservoir area shall be closed to the public between the hours of 10:00 p.m. and 8:00 a.m. of the following day during the months of April through September and shall be closed during the hours of 9:00 p.m. and 8:00 a.m. of the following day during the months of October through March.
 
   (d)   Any section or part of any park may be declared closed to the public by the Mayor at any time and for any interval of time, either temporarily or at regular or stated intervals (daily or otherwise) and either entirely or merely to certain uses, as the Mayor finds reasonably necessary.

961.09   SMOKING PROHIBITED.
   (a)   No person found to be smoking in such designated non-smoking and tobacco-free zones in a park shall fail to immediately cease said activity when requested to do so by City staff, a Police Officer, a person charged with the management, operation or care of any City-owned park, or any baseball or softball umpire or soccer official.
 
   (b)   Should a person found to be smoking in a non-smoking and tobacco free zone in a park not immediately cease said activity when requested to do so, pursuant to division (a) of this section, he or she shall be guilty of a minor misdemeanor.
 
   (c)   Persons who repeatedly violate this section may be permanently banned from City Parks.
 
   (d)   Lack of intent to violate a provision of this chapter shall not be a defense to a violation.

961.99   PENALTY.
   (a)   Whoever violates any of the provisions of this chapter for which no penalty is otherwise provided is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than 60 days, or both.
 
   (b)   Whoever violates Section 961.06 or aids, abets, encourages, counsels or advises the commission of any act which constitutes a violation of Section 961.06 is guilty of a misdemeanor of the second degree and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than 90 days, or both.
